Terms of Service

These terms govern the website design, build, and hosting services provided by Maus Software (“Maus”, “we”, “us”). By commissioning work or using our hosting, you (“the client”, “you”) agree to them.

1. Services

We design and build bespoke websites and host them on our infrastructure. The exact scope of any build is set out in the quote or proposal we agree with you in writing. Hosting is provided on an ongoing annual basis as described below.

2. Pricing & payment

  • Build: a one-off fee, normally £500, payable as set out in your quote. A summer-sale rate of £300 applies to builds commissioned during July.
  • Hosting (“Run”): £95 per year per site, billed annually in advance.
  • VAT: all prices exclude VAT, which is added at the prevailing UK rate where applicable.
  • Invoices are due within 14 days unless agreed otherwise. We may pause work or suspend hosting on overdue accounts after reasonable notice.

3. Hosting & fair use

Your annual hosting fee includes:

  • Static hosting, a global CDN, and TLS certificates;
  • No bandwidth charges — visitor traffic is never metered or billed;
  • Form email: the first 1,000 form-submission emails per site per calendar month are included free of charge;
  • Reasonable storage for a standard marketing website.

These allowances comfortably cover normal use. If a site consistently exceeds 1,000 form emails per month, or storage or usage is materially beyond that of a typical marketing site, we will contact you to agree a fair add-on rate. We may rate-limit, suspend, or charge for usage that is abusive, automated, or clearly outside ordinary business use, where practical after notice.

4. Acceptable use

You agree not to use our services to host or transmit:

  • unlawful, infringing, or fraudulent content;
  • malware, phishing, or material that attacks other systems;
  • unsolicited bulk email (spam) or content that breaches the rights of others.

We may remove content or suspend a site that breaches this clause, acting reasonably and giving notice where we can.

5. Intellectual property

Once a build is paid for in full, you own the final delivered design and the content you provided. We retain ownership of any underlying tools, frameworks, libraries, and reusable components used to build it, and we may reference completed work in our own portfolio unless you ask us not to.

6. Your responsibilities

You are responsible for providing content, timely feedback, and any access we need (for example to a domain), and for ensuring the content you supply is lawful and that you have the rights to use it.

7. Availability

We aim for high availability and monitor our infrastructure, but the standard plan is provided on a best-effort basis without a formal uptime guarantee. We may carry out maintenance that briefly affects availability, and will minimise disruption where possible.

8. Data protection

We process personal data in line with applicable UK data-protection law. Contact-form submissions are forwarded to the recipient address configured for your site. We do not sell personal data.

9. Term & termination

Hosting runs for a 12-month term and renews annually unless cancelled before renewal. Either party may end the arrangement on reasonable notice. On termination, hosting stops at the end of the paid term; we will, on request, help you export your site files. Fees already paid are non-refundable except where required by law.

10. Liability

Nothing in these terms limits liability that cannot be limited by law. Subject to that, we are not liable for indirect or consequential loss, or for loss of profit, revenue, or data, and our total liability is limited to the fees you paid us in the 12 months before the claim arose.

11. Changes to these terms

We may update these terms from time to time. The current version always lives at this page, with the “last updated” date above. Material changes affecting active clients will be notified by email.

12. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
